Indiana law could be allowing mortgage fraud to occur and homeowners evicted from their own property.
The state's Attorney General Greg Zoeller is warning of a loophole in a state law that enables fraudsters to transfer property ownership to themselves. Once this is done, they can fraudulently secure mortgage loans and put the homeowner at risk of foreclosure when they take the money and run.
Currently, Indiana law does not require county recorders to check proof of identification. County recorders are seeking legislation that would require both a thumbprint and a notarized signature to do business.
