New Bill Eases Investigation Hang-ups

A new bill awaiting passage in California promises to help investigators quickly and easily retrieve financial documents during investigation of mortgage fraud crimes.
California prosecutors have been relying on statutes designed for grand theft or general fund as opposed to those written clearly for mortgage fraud investigations and prosecutions. The Senate Public Safety Committee voted unanimously last month to approve a new bill, being carried by Sen. Fran Pavley, D-Agoura Hills, that would alleviate much of the red tape investigators are experiencing.
The new bill's passage would allow police or district attorney's investigators to obtain search warrants based on relevancy to an ongoing felony investigation, instead of probable cause that a crime had been committed.
