Witness Testimony Thrown Out

A witness in the trial of a former mortgage company owner was dismissed after neglecting to produce documents that would back up his claims against the defendant.

Former Evergreen Corp. president David B. Willan is on trial for mortgage fraud. A retired sheriff’s detective, Ed Gruska, was testifying about the arrest of Willan on a misdemeanor charge for a bounced check for a utility bill back in 1992.

When Gruska couldn’t produce documents proving the testimony the judge asked him to step down and leave the courtroom. Jurors were told to dismiss Gruska’s statements.
